TOPIC: Estate Planning – Wills and Enduring Powers of Attorney
According to the statistics only 40% of people in Australia have a will. We will consider the fundamental issues that need to be addressed in preparing a Will including the differences between executors and trustees, how many of them you need to have in your will, their responsibilities to the estate, whether or not you need to refer to everything owned by you in your will, and the importance of ensuring other estate planning documents are consistent with your will. Also considered will be the effect of marriage and divorce on a will and how often your will should be reviewed.
The presentation will also refer to Enduring Powers of Attorney and the two important areas this document covers. We will look at the usefulness of this document in circumstances which include losing legal capacity, as well as how this document can be drafted to suit individual needs and wishes.
William Schoenmaker has 30 years of experience as a solicitor in general practice with a majority of time focusing on family law and estate planning. William is motivated out of a keen desire to enable clients to understand these areas of the law and in turn to help them make informed decisions.
William is a member of the Family Law Practitioners Association, and out of a desire to ‘put back’ into the community, has been a regular volunteer solicitor at the Caxton Legal Centre in South Brisbane over the past 17 years. He has also spoken at community groups dealing with estate planning issues, and various aspects of family law.
